Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you and StackDaily ("StackDaily," "we," "our," or "us") governing your access to and use of the StackDaily websites, mobile applications, and related services (collectively, the "Service"). By creating an account, installing the app, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
StackDaily is a personal health and productivity platform that helps you track nutrition, workouts, habits, tasks, notes, and related data. The Service may use AI to assist with meal logging, workout planning, summaries, and chat-based commands, and may integrate with third-party services such as Apple Health, Fitbit, Google Calendar, and others.
3. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian. You may not use the Service if doing so is prohibited by law in your country of residence.
4. Accounts and Security
To access most features you must create an account. You are responsible for:
- Providing accurate, current information during sign up and keeping it up to date
- Maintaining the confidentiality of your credentials
- All activity that occurs under your account
- Notifying us promptly of any unauthorized use of your account
We may suspend or terminate accounts that show signs of fraud, abuse, or violation of these Terms.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose
- Attempt to gain unauthorized access to the Service, other accounts, or our systems
- Interfere with, disrupt, or overload the Service or its infrastructure
- Reverse engineer, decompile, or attempt to extract source code, except where permitted by law
- Upload malicious code, scrape data at scale, or circumvent rate limits or access controls
- Impersonate any person or entity, or misrepresent your affiliation with anyone
- Use the Service to provide medical advice or services to third parties
6. Your Content
You retain ownership of the content you create, upload, or log within the Service, including meals, workouts, habits, tasks, notes, contacts, and similar entries ("Your Content"). You grant StackDaily a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and create derived data from Your Content solely to operate, secure, and improve the Service for you, and to provide AI-assisted features you choose to use. You are responsible for Your Content and for ensuring you have the right to submit it.
7. Intellectual Property
The Service, including its software, design, branding, and original content, is owned by StackDaily and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.
8. Subscriptions, Free Trial, and Billing
8.1 Subscription plans
StackDaily is offered as a paid subscription with monthly and annual billing options that unlock the full Service, including AI features, advanced analytics, integrations, and unlimited history. Subscription prices are shown in your local currency at the point of purchase before you confirm the transaction. As of the "Last updated" date above, web pricing is $10 USD per month or $80 USD per year(approximately $6.67 USD per month). Pricing in the App Store is set according to Apple price tiers and may differ slightly by region.
8.2 Free trial
New users may receive a 7-day free trial. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription at the price of the plan you selected. If you purchase a subscription before the trial ends, any unused portion of the free trial is forfeited.
8.3 Web subscriptions (Stripe)
Web subscriptions are processed by Stripe. By subscribing on the web you authorize us and Stripe to charge your payment method on a recurring basis at the then-current price for the plan you selected, including applicable taxes, until you cancel. You can manage or cancel a web subscription at any time from Settings → Billing. Cancellation takes effect at the end of the current billing period.
8.4 Apple App Store subscriptions
If you purchase a subscription through the StackDaily iOS app, the following disclosures apply, as required by Apple:
- Title: StackDaily Pro subscription, providing full access to the StackDaily app and Service.
- Length and content: Subscriptions are offered in monthly (1-month) and annual (1-year) periods. During each period you receive full access to all paid features of the Service.
- Price: The exact price for each period is displayed in your local currency on the in-app subscription screen and on the App Store before you confirm purchase.
- Payment: Payment will be charged to your Apple ID account at confirmation of purchase.
- Auto-renewal: Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
- Renewal charge: Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price of the chosen package.
- Managing your subscription: You can manage your subscription and turn off auto-renewal by going to your Apple ID Account Settings after purchase.
- Free trial: Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.
- Links: Our Terms of Use and Privacy Policy apply to all subscriptions.
8.5 Refunds
Except where required by applicable law, payments are non-refundable and we do not provide refunds or credits for partial subscription periods, unused time, or features you did not use. Refund requests for App Store purchases are handled by Apple in accordance with Apple's refund policy.
8.6 Price changes
We may change subscription prices from time to time. We will give you reasonable advance notice of any price change for your plan. If you do not agree to the new price, you may cancel before it takes effect.
9. Third-Party Integrations
The Service can connect to third-party services such as Apple Health, Fitbit, Google Calendar, and others. When you connect them:
- You authorize StackDaily to access the data scopes you grant during connection
- You remain bound by the terms and privacy policies of those third parties
- You can disconnect at any time from Settings
We are not responsible for the availability, accuracy, or practices of third-party services.
10. Privacy
Your use of the Service is governed by our Privacy Policy, which describes what we collect, how we use it, and the choices you have. By using the Service you consent to the data practices described there.
11. Health Information Disclaimer
StackDaily is not a medical device, healthcare provider, or substitute for professional medical advice, diagnosis, or treatment. The health, nutrition, fitness, and AI-generated recommendations available in the Service are provided for general informational and self-tracking purposes only. They:
- Are not intended to diagnose, treat, cure, or prevent any disease or condition
- May be inaccurate, incomplete, or unsuitable for your individual situation
- Should not be relied on for medical, dietary, mental health, or fitness decisions
Always consult a qualified healthcare professional before starting a new diet, exercise program, or making changes to existing treatment. If you think you may have a medical emergency, call your local emergency services or a healthcare provider immediately. Never disregard or delay seeking professional medical advice because of something you read or saw in the Service.
By using the Service's health features you acknowledge that you use them at your own risk, and that StackDaily is not liable for outcomes related to your health, fitness, or well-being.
12. Termination and Account Deletion
You may cancel your subscription and delete your account at any time from Settings. Account deletion permanently removes your data in accordance with our Privacy Policy.
We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, abused the Service, or created risk for other users or for us. We may also discontinue features or the Service at our discretion.
13. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, StackDaily disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any data, calculations, recommendations, or AI outputs will be accurate or reliable.
14. Limitation of Liability
To the maximum extent permitted by law, StackDaily and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total cumulative liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid StackDaily in the 12 months preceding the event giving rise to the claim, or (b) USD $50.
Some jurisdictions do not allow certain limitations of liability, in which case those limitations apply only to the maximum extent permitted by law.
15. Indemnification
You agree to indemnify and hold StackDaily harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, Your Content, or your violation of these Terms or applicable law.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in San Francisco County, California, and you and StackDaily consent to personal jurisdiction there. Nothing in this section limits any non-waivable consumer rights you may have under the laws of your country of residence.
17. Apple-Specific Terms
The following applies if you obtain the StackDaily app from the Apple App Store. You and StackDaily acknowledge that these Terms are concluded between you and StackDaily only, and not with Apple. StackDaily, not Apple, is solely responsible for the app and its content. Apple has no obligation to provide maintenance and support services for the app. To the extent of any conflict between these Terms and the Apple Media Services Terms applicable to subscriptions, the Apple terms control with respect to billing handled by Apple. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the "Last updated" date, and where appropriate by email or in-app notice. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.
